Carminder Summer Promotion 2017 Terms & Conditions

By being notified of the Promotion, or otherwise receiving these terms  and conditions, you are deemed to have read and accepted the following terms and conditions unless you notify the Promoter that you do not want to take part in the Promotion.

  1. The Carminder Summer Promotion 2017 (“Promotion”) will run from 6 March 2017 to 28 April 2017 (“Promotion Period”).
  2. The Promoter is Credit Union Insurance Limited (trading as Co-op Insurance NZ), Level 3, 25 Teed Street, Newmarket, Auckland 1023, New Zealand (“Promoter”).
  3. Subject to points 5 and 6 below, all bundled Carminder Comprehensive vehicle insurance policies with Vero House and/or Contents insurance policies which are live and not in arrears (the “Policies”) at:
    • 31 March 2017 will be entered into the March Monthly Prize Draw to be drawn on 3 April 2017; and
    • 28 April 2017 will be entered into the April Monthly Prize Draw to be drawn on 3 May 2017.
  4. Subject to points 5 and 6 below, all Carminder Comprehensive vehicle insurance policies and Carminder Third Party vehicle insurance policies which are live and not in arrears (the “Policies”) at 5pm on 28 April 2017, will be entered into the Grand Prize Draw on Monday, 1 May 2017.
  5. To be eligible to enter and win, Policies must be held by a member of a participating credit union (a “Participating Credit Union”) and must not be in arrears on the date of the prize draw.
  6. The following policyholders are not eligible for the Promotion:
    • employees and directors of Participating Credit Unions and each of their immediate family members;
    • the Promoter’s employees, directors and each of their immediate family members; and
    • Co-op Money NZ Group (Co-op Money NZ, Co-op Insurance NZ and Co-op Services NZ) employees and immediate family members.
  7. All eligible Policies will be automatically entered into each Monthly Prize Draw and the Grand Prize Draw unless the relevant policyholder notifies the Promoter that they do not want to participate in the Promotion.
  8. The prize winners (“Winners”) will be determined by random draw from all eligible entries at the Promoter’s office in Newmarket, Auckland. If a Winner does not agree to be bound by these terms, they will not be eligible to win a prize, and a new Winner will be selected.
  9. There are three $150 cash prizes (“Cash Prizes”) to be won in each month during the Promotion Period, being three Cash Prizes in March and three Cash Prizes in April (“Monthly Prize Draw”). There are six Cash Prizes to be won in total.
  10. There are three grand prizes (“Grand Prizes”) to be won:
    • The first valid entry drawn in the Grand Prize Draw will win a Sony 40” Full HD Smart TV (valued at $1,500);
    • The second valid entry drawn in the Grand Prize Draw will win a Xbox One Slim console (valued at $569); and
    • The third valid entry drawn in the Grand Prize Draw will win a $500 Harvey Norman gift card (valued at $500).
  11. In the event that a Grand Prize or any part of a Grand Prize becomes unavailable for any reason beyond the Promoter’s control, the Promoter may at its sole discretion provide an alternative prize.
  12. Grand Prizes are not transferable, changeable and cannot be redeemed for cash.
  13. Acceptance of any prize is deemed consent for a Winner to allow the Participating Credit Union through whom they purchased the Policy and the Promoter to use that Winner’s name and images for promotional purposes without any further reference, payment or other compensation.
  14. The Winners of the Monthly Prize Draw will be notified by the 10th of the following month by phone, which will be Monday, 10th April 2017 and Wednesday, 10th May 2017.
  15. The Winners of the Grand Prize Draw will be notified by Friday, 5 May 2017 by phone.
  16. Where attempts to contact the Winners fail (e.g. when a Winner cannot be contacted by phone after three attempts), the Promoter may select another Winner on the same terms as the original prize draw.
  17. Each Winner’s image and name may be used for publicity purposes and the Winner agrees to make himself or herself reasonably available for this purpose (without compensation).
  18. The Promoter reserves the right to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant or an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these terms and conditions or the spirit of the Promotion.
  19. The Promoter’s decisions on all matters related to the Promotion will be final and no correspondence will be entered into regarding the same.
  20. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  21. The Promoter, its employees and agents will not be liable in any way (including, without limitation, in negligence) for any loss or damage whatsoever incurred or suffered (including, without limitation, indirect or consequential loss) or personal injury suffered or sustained in connection with either participation in the Promotion or with the use of any prize offered, except any liability that cannot be excluded by law.
  22. As a condition of participating in the Promotion, all entrants and Winners of the Monthly Prizes and Grand Prizes indemnify the Promoter, all organisers, sponsors and all other persons and organisations associated in any way with the Promotion against all claims, damages, liabilities, costs and expenses (including legal fees on a solicitor-client basis) which it may incur arising out of their participation in the Promotion and/or participating in the prize, howsoever caused.
  23. You acknowledge that the Promotion is provided at no charge and accordingly the exclusions of liability and indemnity set out in these terms are fair and reasonable.
  24. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to modify, suspend, terminate or cancel the Promotion, as appropriate.
  25. The Promoter will not be liable for delays in delivering any of the Promotion’s prizes or problems caused by circumstances outside of its control, including, but not limited to strikes, fires, floods, earthquakes, other natural disasters, acts of terrorism and blackouts.
  26. This Promotion is being managed and conducted in New Zealand and New Zealand legislation applies.
  27. The Promoter collects and holds personal information provided by entrants for the purposes of this Promotion and for future promotional purposes. Failure to provide requested personal information may disqualify a person from being able to receive a prize. All personal information provided by entrants will be held by the Promoter in accordance with the Privacy Act. Under the Privacy Act 1993, entrants have the right to access and request correction of any such personal information, and may do so by sending an email to info@coopinsurancenz.co.nz.
